Legal Framework

It is important that the legal framework for institutional investors aligns with both the legal traditions of a country and the nature and scale of its capital markets - otherwise it will not succeed in facilitating sector development.

Cadogan Financial has drafted legal regimes for institutional investors in many emerging markets worldwide, both in common law and in civil code countries.

In Rwanda, we wrote a legal and regulatory framework for capital markets to enable and empower a regulator and regulate markets.

In Botswana, we wrote a new law for collective investment undertakings, together with a regulatory framework.

In Tanzania, we drafted a legal framework to implement our proposed reform of the pension fund sector and a framework for introduction of municipal bonds.

In Burundi we drafted a complete set of 3 laws and 12 regulations for the planned capital market in both English and French.
